Belgian firm loses EU methyl bromide appeal

A bid by Belgian pesticide importer Mebrom to win compensation from the EU on the grounds that it was not awarded quotas to import methyl bromide in 2005 has been rejected by the European court of justice. Judges dismissed its claim because the firm had "distorted" a calculation of losses allegedly caused by European commission delays in introducing an online quota distribution system. In addition, the shift to critical use quotas rather than import quotas from 2005 meant that Mebrom was no longer automatically entitled to import methyl bromide, the court said (EED 10/12/04).
