Portugal adopts EU environmental liability rules
Portugal adopted on Thursday legislation transposing the EU's 2004 directive on environmental liability into national law. Many member sates still have not implemented it (EED 13/02/08). The Portuguese law must receive presidential approval before it can enter into force. It extends liability to individuals and parent companies of firms involved in environmental accidents, and creates an emergency environmental intervention fund partially financed by fines for environmental offences. France is expected to adopt the 2004 directive shortly (EED 29/05/08). See government press release.
