Opponents of German pack deposits beaten again
A German administrative court has dismissed yet another legal challenge to the government's deposits on one-way drinks containers. It was mounted by foreign drinks importers alleging that the deposits violated EU rules on free movement of goods. The Stuttgart court said that because a national clearing scheme was emerging, it could not be argued that the deposits necessarily conflicted with EU law. Last December, Germany's upper parliamentary house approved legislation clearing the way for the national scheme (EED 17/12/04). Germany's environment ministry urged remaining opponents of the deposits to participate. See press release.
