Second blow for illegal German waste fund
Germany's constitutional court has ordered the government to repay waste firms €4.4m in illegally charged waste export fees. Since 1994, the "solidarity fund" has paid for repatriation of illegally exported shipments of waste. It is incompatible with Germany's constitution, the court ruled. The fund is already being scrapped by the government following a 2003 European court of justice ruling that its mandatory fees breached EU law on customs duties (EED 27/02/03). The German environment ministry insisted that the fund had helped reduce the number of shipments requiring repatriation. See press release.
