Commission publishes EU liability proposal
The European Commission today finally unveiled its plans for an EU environmental liability regime. The announcement was made as this edition of ENDS Europe DAILY was due to be published and we will carry a full report tomorrow. The proposals are essentially unchanged since the Commission's environment directorate indicated in December it would propose exempting companies complying with pollution permits from strict liability for damage caused by that pollution (EED 10/12/01). That provision is included in the text adopted by the Commission today. See European Commission press release.
