German court silences deposits' opponents
Germany's supreme administrative court has thrown out an appeal from drinks packagers to have deposits on certain one-way drinks containers barred in North-Rhine Westphalia (EED 28/11/02). Had the Leipzig court agreed to hear the case, a new date would have been set to rule on the legality of the deposits, which took effect on 1 January. This will no longer be necessary. The claimants' lawyer said they would now appeal to the constitutional court. That court has already rejected a separate lawsuit from retailers seeking to stop the deposits (EED 03/01/03).
