Petroleum coke "not waste" says EU court
Petroleum coke produced deliberately or as a by-product from manufacture of other fuels in a refinery, and intended to be used as fuel, should not be classified as waste under EU law, concludes an order issued by the European court of justice earlier this month. The question of whether petcoke should be considered as waste had been raised by an Italian judge dealing with a lawsuit concerning a refinery in Sicily that was controversially allowed to resume production two years ago (EED 13/03/02). See order in case C-235/02.
