More pressure on Dutch waste export curbs
Dutch rules limiting exports of waste for recovery breach the EU's 1993 waste shipments regulation, a European court of justice official argues in an opinion released on Thursday. Francis Jacobs agrees with the European Commission that the law perpetuates a policy of self-sufficiency in waste for recovery - in direct contradiction to a 1998 court ruling (EED 26/06/98). Following a court ruling last year, it is also illegal for the Dutch authorities to use calorific value of waste to determine whether incineration is classified as recovery or disposal, he argues (EED 13/02/03). See case C-113/02.
