Further test for EU waste shipments law

The European court of justice has issued another interpretation of EU rules on cross-border shipments of waste. Faced with a proposed shipment it believes to be wrongly classified as for recovery rather than for disposal, the competent authority of the exporting country cannot unilaterally reclassify it, according to the court. Tuesday's ruling responds to questions posed by a Belgian court arbitrating in a dispute about proposed exports of Brussels incinerator ash to Germany. The governments of Germany, Italy and the Netherlands all intervened in the EU proceedings. See judgement in case C-472/02.
