Commission rebuffed over Dutch particle limits

European court says Brussels failed to take all relevant data into account before rejecting stricter national limits

EU judges have annulled a European commission decision to reject tougher fine particle emission limits proposed by the Netherlands for new diesel cars and light vans.  Judges backed recommendations made earlier this year (EED 21/07/08) in a ruling issued on Thursday.

Judges said the court of first instance (CFI) should not have dismissed a Dutch legal challenge against the decision as "unfounded" (EED 27/06/07).  The commission failed to take all relevant data into account before rejecting the proposed emission limits, they said.
