EU court to rule on German packaging deposits

Claim by Austrian drinks firms that one-way levy contravenes EU rules referred to European court of justice

A German court has asked the European court of justice (ECJ) for a preliminary ruling on whether national deposits on one-way drinks containers due to be introduced on 1 January 2003 contravene EU law. Baden-Württemberg's state administrative court in Stuttgart put a case brought by Austrian drinks manufacturers on hold while it seeks clarification from the ECJ on whether the charges constitute discrimination within the single market or breach an EU packaging directive.
