Court "wrong" over Dutch particulate limits case

Adviser says EU judges should annul ruling upholding commission decision to reject proposed emission limits for diesel vehicles

The European court of justice should annul a ruling in a case brought by the Dutch government against the European commission over Holland's fine particle emission limits, a court adviser has concluded.

Last year, EU judges upheld a commission decision to reject tougher emission limits proposed by the Netherlands for new diesel cars and light vans. Holland's legal challenge was dismissed as "unfounded" (EED 27/06/07).
