Planning authorities cannot put a time limit on legal challenges for new projects if the public is unable “to actually participate in the environmental impact assessment” prior to planning permission being granted, the European Court of Justice (ECJ) said on Thursday in a case involving a resort development on a Greek island.
A notice about the planned construction work on the island of Ios in the Cyclades was posted in the local administrative offices on Syros, an island some 55km away, as well as in the latter's local newspaper.
