EU court refuses to rule out intra-EU ISDS in reformed Energy Charter Treaty

The EU Court of Justice has rebuffed a request to soothe member state concerns on whether the 'Achmea ruling' – banning intra-EU investor-state dispute settlement (ISDS) mechanisms – will also apply to a renegotiated Energy Charter Treaty.
